I always thought "judicial review" meant that if a case is brought before a court, the judge could question its constitutionality and rule against it. I did not know that a judge of any level court could just suddenly take it on themself to rule against the POTUS out of the blue because he felt like it, like that jerk that demanded a plane full of criminals return immediately. Hahahha..
Even the Supreme Court has to wait until someone opposes a law or decision and brings it to their attention. right?
Otherwise, any judge in Bugtussle, Arkansas could just countermand decisions by the president.
We got a lawyer on the site, what does he say?
@Cliff-Mashburn saidHe didn't "take it on himself". He was ruling on a lawsuit brought on the prisoners behalf by Democracy Forward and the American Civil Liberties Union. https://www.usatoday.com/story/news/politics/2025/03/15/judge-blocks-trump-alien-enemies-act/82408225007/

RE: "Since when do judges get to declare a law unconstitutional because they feel like it?"
They don't. Your subject line frames this incorrectly.
@AThousandYoung saidActually, much of the government is trying to act normally; it's the president who is acting very strangely.
I always thought the power of the purse belonged to Congress but this President seems to think he can unilaterally refuse to spend money Congress had authorized. Our government is acting very strangely.
