1. Are games in set piece tournaments rated? (That is, games with a starting position other than the standard starting position.)

2. Is there a control that allows a tournament director to make ALL of the games in a tournament rated or not rated? Thanks.

Yes, that's misleading. Set piece games are always unrated, unless they are tournament games.
