timebank elapsed

in a tournie, my opponent´s timebank has long elapsed and his vacation flag is still on. why cant I time him out? would he be allowed to move the moment he wishes?

Maybe he booked a 36 day vacation (or some of it). In which case it's tough, you can't time him out.
