If your opponent does not move in the 7 day period is the game a draw or do you win?
Does their not moving hurt your rating?

You can either claim a time-out win, either wait until he moves.Claiming the time-out will count as a win.

Ok thanks. However, my opponent has taken longer than seven days (the time limit was set to seven days) and there is no skull in sight. Just wondered for this time and also so that I don't get caught out either!

When a game has timed out it will be shown on the right side of the game listed on your 'My Games' page.

The time out period is computed using the date and the time since the last move.
