my opponent has been banned but his game is still listed.why?

I suspect that its because the match may be important in a tournament, clan match or seige.

You will be able to claim the game when your opponent times out.

it often takes some time before the games are stopped.

Games against banned players are "frozen", so you can't do anything with them yourself, even if your opponent times out. They eventually get auto-resigned (without affecting your rating).
