If there isn't a way out of the perpetual check, then its a draw. (If you don't accept the draw, the 50-move rule or a 3-fold repetition will kick in anyway).
Avoiding perpetual check when you're in a better position is just as important as avoiding stalemate.

Yes, that is a perfect legal tactic. If someone is behind in material or losing in some other way, giving perpetual check is a good way out. The opponent should have seen it coming and avoided it.

I understand that it is disappointing 😉. But if you cannot do anything else or don't want to do another move, then you should accept the draw (unless you want to play this game until the end of times 😉).

I don't know the official rule exactly. But if position on the board occurs three times (not necessarily in a row) then it is declared a draw. I don't think that RHP does this automatically however.

This is a question that pops up on occasion - the first time you draw a "winning" game due to this tactic used against you it stings. 🙂

But the next time you should expect it. If you are in a loosing position, then you are not only authorized, your goal should be to try and find a perpetual mate in order to force a draw. Similarly, if you are winning, you should keep an eye out for the fact that your opponent is looking for a perpetual check, and try to make sure that he won't be able to.

There is nothing underhanded whatsoever about perpetual check, it is part of chess stragegy, used by players from the novice (who's already learned the hard way that perpetual checking is ok 🙂 ) to grandmaster.
