You are in check and Bh2-d6 does not relieve you from the threat, therefore it is illegal.

yes, i see that i am in check but i thought that the move to D6 would eliminate the pawn

That's not how en passant works. Only a pawn can take on the square behind the freshly double advanced pawn.
