You are in check and Bh2-d6 does not relieve you from the threat, therefore it is illegal.

Edit: oh geez, fat Sam beat me. I don't mind being beat, but by someone that looks like that........ I need a beer or 8 to drown my sorrow.

yes, i see that i am in check but i thought that the move to D6 would eliminate the pawn

That's not how en passant works. Only a pawn can take on the square behind the freshly double advanced pawn.

my mistake .. i didn't realzie that only pawns can do en passant capturing moves
