What are your thoughts on this.

They put the vacation sign up, so they don't get timed out...and then keep moving...

Just my imagination ? Is this possible? Is there not sumthing to prevent someone doing this?

Timing 'em out is your choice, regardless of the vacatio flag. If you don't think it's in good faith, just time 'em out...

It is possible to switch the vacation sign off for a moment to move in a few games, and then switch it back on.

The reasons for doing this may be honest, or disingeneous - see what your opponent says in his vacation notice on his profile. Perhaps he's on a vacation but can occasionally spend a little time in an internet cafe or something to move in a couple (but not all) of his games.

Of course he may just be avoiding your game too. If you are unsure, I recommend that you drop him a polite note, saying that you've noticed him moving in other games on his vacation, and that you are wondering what his status is, seeing that your game with him is over the TO limit.
