"The 9th Circuit Court of Appeals on Friday ruled that President Trump’s use of emergency powers to allocate millions of dollars in funding for the construction of a southern border wall was illegal, the latest blow to the Trump administration’s effort to limit immigration.

In the 2-1 decision, the court upheld a December 2019 district court summary judgment in favor of a request from the advocacy groups the Sierra Club and the Southern Border Communities Coalition against Defense Secretary Mark Esper, acting Homeland Security Secretary Chad Wolf and “all persons acting under their direction ... from using military construction funds appropriated for other purposes to build a border wall.”

"The appeals court said that while the district court had previously agreed to suspend an official order stopping construction pending the government’s appeal, Friday’s ruling lifts that stay, thus ordering the immediate halting of border wall construction. "

as a sovereign country, does the US not have a right to set the number of immigrants? and as a duly elected president doesnt Trump have the right to make this decision?

But, I thought you fellers said that Trump had broken a promise, that he didn't build a wall. So,,,,there's a wall? First I've heard about it. I thought y'all were really making fun of us Trumpies, that he had failed miserably:, that, of all his 100 promises, he was only able to do 99 of them. So, there's a wall?

Trump has built a wall? How long is it? Wish y'all had told us about it, you have been disingenuous , to say the least. We would have told you, if we had screwed up.

Rules regarding immigration are entrusted to the Congress by the US Constitution.

The executive branch has this authority via homeland security and US citizenship and immigration services. Congress gave away their control and the constitution doesnt have much about it...only referring to slaves.

You obviously don't know what you are talking about. The President can't unilaterally impose immigration laws; we haven't made him a Fuehrer.

I didnt say he could. It is the executive branch that does and he is head of the executive branch and I image a lot of say so. You must be thinking of obama and daca.

I wasn't wrong so I can't admit to a lie.

Study this provision carefully:

"The Migration or Importation of such Persons as any of the States now existing shall think proper to admit, shall not be prohibited by the Congress prior to the Year one thousand eight hundred and eight, but a Tax or duty may be imposed on such Importation, not exceeding ten dollars for each Person."

US Constitution, Article I, Section 9

It means that after the year 1808, Congress can prohibit the migration of persons. That's called "immigration" in case you are unaware.

There is nothing in the Constitution giving such a power to the Executive Branch. True, Congress can delegate portions of the power (it would obviously be unwieldy if every person who wished to immigrate required a special act of Congress) but you are incorrect to think that Congress has "gave away" such power. It Constitutionally cannot.

About 300 miles of wall have been built, but only five miles are new. The rest are replacements for what were already in place.

Despite Trump's insistence that Mexico would pay for the wall, it has been funded entirely by the U.S. government at costs that reach nearly $30 million per mile in southern Texas.
