DALLAS - An HIV-positive man convicted of spitting into the eye and mouth of a Dallas police officer has been sentenced to 35 years in prison.
Because a jury found that Willie Campbell used his saliva as a deadly weapon, the 42-year-old will have to serve half his sentence before becoming eligible for parole. He was sentenced Wednesday.
Campbell was being arrested in May 2006 for public intoxication when he began resisting and kicking inside the patrol car, Dallas police office Dan Waller testified.
Campbell was convicted of harassment of a public servant.

If I punch a police officer I wont get 35 years even though my fist is potentially a deadly weapon.

It hinges on whether they know they have it and the conditions on what happened.
If it was reasonable to conclude that you intended to kill an officer then you could get 35 years.
Most people survive a punch in the face and most people recover without any permanent damage.
That being said, I think this is a bit of an extreme case since there has never been any known transmission through saliva. I think he probably deserved a charge of assaulting an officer, but probably not 35 years.

There are people in California, I hear, who are in prison for life for bouncing bad cheques ("three strikes and you're out"?)... thanks to successful candidates winning hairy chest competitions about sentencing policies as they were seeking political office.
