Depends what the consequence of "losing a war" is. If it's the Iraq war which is predicated on greed and trickery and the consequence of losing that war is allowing people to have their country back, then yes.

The fact is that in war, morals fly out the window faster than a lit firework. In the end in conflict there can be no moral 'right and wrong', both sides are doing their jolly well best to kill each other as quickly as possible.

It was not uncommon for American soldiers to shoot Japanese soldiers who surrendered in the Pacific theatre of World War II.
This is the reason we have such bodies as the United Nations and the Internation War Crimes Tribunal, to try to impose some form of accountability on those who fight. If we take a recent example, the killing of thirty-seven children by one bomb in Qana in the current Isreali-Lebanese war, we see that the Isrealis have een accused by the Lebanese of a war crime. However, the Isrealis will win this war, that much is obvious, and you can bet that no one on their side will face prosecution in either a civil or military court.
