I will put it this way. At Nuremberg, it was considered 'something to think about' do you not agree? The judiciary of the moment considered...should that defense carry any weight??. These nazi officers were following orders. If we had troops in WWII given leeway to decide if they should obey an order or not, our military would have ground to a halt. First rule of combatants is to follow orders.

The main word in what these senators said was "illegal".

By throwing a hissy fit, and claiming that "they want the military to ignore their CIC", he is claiming that all he puts out are illegal orders. His argument doesn't say what he intended to say.

OF COURSE illegal orders should be refused. And YES, Hitler's soldiers SHOULD have refused illegal orders. And NO, this doesn't enable grunt soldiers to refuse anything they want to refuse, but it does say they can refuse ILLEGAL orders.

The line not to be crossed is self-evident.

8USC 1182(f) gives the president of the power to suspend the entry of aliens or impose restrictions whenever he finds that the entry would be detrimental to our interest. I found that to be a pretty strong power. Further, the congressional research service explains that this is exactly how many presidential administrations have used the power. It is a sweeping proclamation power.

8 USC 1185(a)(1) gives the president the authority to regulate entry and departure by aliens, under such reasonable rules as he may prescribe. (what do you thiink 'regulate departure' means.? To me, send them back.

So, Suzianne, these are not my opinions,... legally he is relying on these sections, which give him broad power to suspend entry of noncitizens if he finds it is in the national interest. Pretty cut and dry. That's not a fringe theory… Both Democrat and Republican presidents have used this power before.
