The final responsibility to invest in anything lies with the investor.

There where many red flags about Madoff's company that should have made investors wary. Yet, many succumbed to greed, as is often the case. (Read the Wikipedia article)

They are at least partly responsible for their losses.

The only guy (at least in the U.S. ) who ever came up with a bigger Ponzi scheme than Madoff was FDR when he created Social Security.
