I'll cut straight to the solution:
Privatise the FDA, any company wishing to register their product with the FDA can go through the procedure and pay for it as they do now. When their product comes out the other end it'll have a stamp on it. The customer then chooses voluntarily (redundant use of the word 'voluntary' there but I can see how people making their own choices irks you) the product with the stamp or, assess the risk of buying the product without the stamp. There are hundreds of products held up in the FDA process that could be improving peoples lives right now. The regime also acts as a deterrent to developing new drugs (how many lives?) With a limit on patent life, why invest in R&D when half the patent life is used up just trying to get your product on the shelf.
If the FDA is all you make it out to be it'll be able to stand on it's own two feet.
