games that haven't started (defined as less than 2 moves by each player) can't be claimed as T/O but can be deleted.
If your oppo isn't moving I suggest you delete the game and start another with someone else.
Russ / Chrismo have made sure that this particular cheat can't work: thus the game in question did not timeout.

I'm (pretty) sure Toe wasn't accusing you of cheating, rather he was pointing out why it is a necessary rule to prevent cheating. In your case you started a game in good faith and your opponent disappeared, which is unforunate. I hope you have better luck in your next one.
I'm not in favour of any cheating accusations in the forums at all: give such to the site admins and let them deal with it.
