...difficult ethical question about vacations TOs, so I'll make this brief and painless:

1. Last move - 26 June, more than 1 month ago
2. TO-7 days
3. Communication-1 email to opponent, about a week ago, no answer
4. Opponent-established pawnstar
5. Quality of game-high, no real advantage yet for either

Do I take the TO?

If you don't move in a month, you can't expect anything else than to get timed-out.
Of course,if you don't claim it,and he/she returns, you would still have that nice, close battle to finish.
I struggle with this all the time.Have never claimed a win,but often wanted to.I think I'm going to take a ferm stand on it in the near future. When you see this line in my profile: 'Time is up,game over!',you know I will claim every game.

Not sure I will do it though,it's not really how I want to win.
Difficult....😕

I know where you're coming from - a month is a long time. But I have several colleages who take off 3-4 weeks holiday in July in one go (I don't get that much holiday for the whole year!) so he might be on holiday still. Do you talk? Maybe he doesn't speak English enough to say that he'll be away a long time.

I'll come back to my usual point on TO's. If you have a good game going and you TO you gain a few 'points'. If you leave the game open you maybe get to finish an enjoyable game. You have a star, so what does it hurt to leave the game open?

I have a similar situation: myy opponent has not moved since the 15th june, Pawnstar etc. who has not even their vacation flag on.

As it happens, I know from rumour that the player is having difficulty getting to a PC, so until such time as the game clutters up my screen too much (how?) I'm quite happy to leave it just on the offchance the game ever resumes again. After all, its not the points I'm after, though if I loose now (about even in game), then I have a lot of points to loose (as many many others have taken the TO option, my opponent's rating is now very low).

But why TO is my 'moral' addition to the debate. A nice moral ideology is 'be nice': leaving it X months wont harm you, and your opponent, if they ever appear again, might be jolly happy to resume, thinking 'what a nice chicken that is'. Happyness makes the word go round etc etc etc.

Whether you have your vacation flag up or not, I say that if you can't make a single move in a whole month, you deserve to lose. I have no sympathy for him. Claim the victory.

T think there are two points coming across in the replies so far:
1. ethically, there is no problem with you claiming the win;
2. if your priority is to win and get some points, then claim, but if your priority is to play enjoyable chess, then wait.

I recieved an email from him today stating that he'll be leaving RHP for a few months, and telling me to take the TO. So my ethical conundrum is moot. Incidentally, this person was Novaboy, one of my favorite opponents and people to talk to. I'm sad to see him go.

It isn't a rated game until you both complete two moves.

Since he hasn't made any move at all, I would suggest deleting the game and just move on to someone who wants to play.
