Thanks Suzi. I've learned something about the site (again).
The software is rarely at fault in these instances but I can't see a reason either.

I've just looked at one of my games where the opponent is "on vacation".
It does say on his profile no days remaining.
That to me just means all his days are used up for this year.
It doesn't mean his booked days don't go further than today's date.

Dunno if I know the reason either, but the site angels can always clear stuff up for us.

I am on vacation until 31 December which has used all my days for the year.

So, showing as no vacation left but cannot be timed out until 1 January; I think that could explain the scenario per the OP.
