time out

I have an opponent who has not moved in a very long time. The skull appeared beside that game today, and when I clicked on it, a message asks me if I want to claim the win by time-out, as usually happens when I click on a skull. However this time, when I click on 'yes,' nothing happens. He does not have his vacation flag up. Since it's a Clan game, I want to claim the win by time-out. How do I claim the win?
