Far as I know... it's a draw.
And the moves don't have to be in sequence either. Make a bunch of move in between but once you hit that third repetition... draw!
But you mean 9 moves, right? Unless I've totally butchered the math, it takes at least 9 moves to repeat a postion 3 times.

If the positon has been repeated 3 times, but your opponent won't agree to the draw, just send a message to Russ, explaining what happened. He'll look at the game, and if it really is a 3-fold repetition, he'll probably declare it drawn.
Russ has done that before, for instance in the game between Bbarr and Curator (Curator repeated the position at least 4 times, but refused to accept Bbarr's draw offer).

No.It is not a draw.In such a case a player can claim a draw if he wishes.But it is not a draw by rule.If none claims it,play continues.Since this site doesn't rcognise it,and we don't have a referee I think policy should be to accept the draw when someone claims it.

I "produce" the third repetition and do NOT claim the draw. do I have the right to claim it later (I dont think so!)? and (better question) does my opponent have the right to claim the draw?

If you don't claim it and neither does he/she,you'll have to reach the position a fourth time to claim it,I guess.Not so sure about that one,rather weird situation,but it seems to be the logical thing to do.
