It is illegal when any side has a privelage to capture his opponent's king , so if I checked you and you checkmated me back , then I wuold be the first one to take your king , so I would win but king taking is impossible in chess (excepting Monochrome Chess) so it's obviously illegal.

Must not be in check to deliver the mate. It doesn't matter one iota if you on the next move you'll checkmate. You're in check! Sorry!

you can however deliver mate while getting out of check🙂

My favorite is this:

H. Fraenkel
Adventures in Chess, 1951


White plays 1.Bg2+ and announces mate. However, Black replies 1...d5#! and says, "No, you're the one who's checkmated!". In a huff, White retorts, "Not so! I can capture your pawn en passant, so it never really reached d5, and you never really got out of check!".

This looks like it was a composition. Was it from an actual game?
