FIRST off, I must make a comment before I address the question. RAMNED, and here I thought I was debating with someone who actually understood chess. Jeez. When you asked the question of what is OTB 40/120, you may as well have asked who moves first, white or black. For ANYONE who is remotely into chess, OTB 40/120 is BASIC COMMON knowledge. OUCH!! I am afraid I cannot engage you in any further debate, because of this.
Now, as to the question. Yes, it is a legal position. After a thorough analyzation by Fritz, it is .06 in favor of white, a DEAD DRAW. White's next move is either Rc1, setting up the pushing of the passed pawn on d5, Or Be6+, pressuring the king. AS you might suspect, I personally favor Be6+ for hte simple fact that it puts black on the defensive while constricting its breathing room. It is far too early for any other predictions.
