Put in the TOS that by subscribing, you're agreeing if you're "convicted" of cheating by a panel of unbiased RHP players after careful consideration of the evidence and a chance to defend yourself, you're out and you don't get your money back.

There's no reason why such a provision wouldn't be binding.

But that would probably open Russ up to all sorts of complications. If he refunds the $'s then there's less legal risk, I would think. Otherwise, he'd at least get hit with challenges via the credit card companies.

Why is it ridiculous?If no refund a site owner might find himself in a courtroom trying to prove the user really did cheat.A not so appealing prospect.
It's why I think bannings aren't so effective(they come back anyway).A better system would be to tag them and prohibit from tournaments.But that's just my opinion.

I doubt that,I think most reckon they will get caught eventually.
Besides,by tagging and prohibiting you destroy it just the same; no more tournaments and would you play a tagged player?It has the added benefit of subscribers having to pay for a second account if they want to start anew.

Exactly. That's what ICC does. They stamp their account with a (C) and keep them out of tourneys.

Why not divide the money into months or weeks and only refund for any remaining time left on the subscription?
