Yes, but McCain is also a federalist and medical marijuana is a state issue.

Is it REALLY a state issue?

Or is the federal government sending SWAT teams info california raiding cancer patients of their medicine?

McCain: "The law is the law, and I do not believe it's going to be changed, and it's not going to be changed by me."

"Marijuana, for any use, is illegal under federal law." http://marijuana-as-medicine.org/Federal%20&%20State%20Law.htm

People have been arrested by the Feds for violation of federal drug laws in states with legal medical marijuana under state law. McCain's statements don't seem to indicate that that would change under a (fortunately unlikely) McCain administration.

How does the US justice system reconcile such a blatant discrepancy in the laws?

What is the topic here? Whether Marijuana should be legalized or whether McCain will undo what's been ratified under state law?

If it's whether or not marijuana should be legalized, that topic got boring here a long time ago. Just asking.

That's "federalism" for ya.

If it's a legitimate area for the Feds to act in, then Federal law trumps State law on the same subject. The US Supreme Court in Raich v. Ashcroft said that regulation of drugs is "interstate commerce" even if the drugs are grown not sold and used solely inside a state.

Here's a site giving the particulars on Raich v. Ashcroft: http://blogs.salon.com/0002762/stories/2004/11/23/raichVAshcroftAGuideToTheS.html

This is a FACT. Google it. Feds are raiding innocent patients and throwing them in jail where they die from their cancers...

This an ongoing battle between the Federal and State. Yep.

Why are you concerned? Plan on coming down with cancer soon? There are plenty of leagal drugs for pain, Pot is not the cure-all just because you like hitting the bong.

The raid was on a co-op, where you have a bunch of pot-heads, who were growing alot of it. Individuals that have a dotors note, and grow enough just for themselves don't get hassled.

Take another toke, and relax. We won't bust you today. Maybe tomorrow.
