"The Justice Department has decided to abandon its efforts to seek criminal charges against former FBI Deputy Director Andrew McCabe, according to his attorneys.
McCabe's lawyers were told last September that McCabe should expect to be indicted on charges stemming from inaccurate statements he made to FBI investigators about his actions around the time of the 2016 election. However, no indictment was ever returned, leading to speculation that the grand jury took the rare step of rejecting charges.
Prosecutors had been cagey since that time about the status of the investigation into McCabe, who has been a frequent subject of public attacks from President Donald Trump. But on Friday, the U.S. Attorney's Office in Washington sent McCabe's lawyers a letter saying, "We consider the matter closed."

It doesn't appear the prosecutors could even convince a Grand Jury to file charges under a very low standard of proof nevermind convincing a petit jury to find McCabe guilty beyond a reasonable doubt.

Indeed, the extraordinary thing about McCabe’s case compared to these ones is that the Justice Department appears to have engineered McCabe’s firing, ostensibly in response to the inspector general’s finding of a lack of candor, mere hours before his retirement eligibility. It’s true that the FBI routinely treats lack of candor as a fireable offense—but it remains unexplained why the Justice Department seemingly raced the clock in order to push McCabe out rather than proceed at the usual pace and note that he would have been subject to disciplinary proceedings if he had not retired. That alone is a vindictive level of harshness relative to the norm. Criminal prosecution is several standard deviations from the norm."

That the Donald wants people he perceives as his political enemies treated in a far more vindictive way then similar cases were always handled in the past is no reason to do so. And anyway, it seems the DOJ did try to get a criminal indictment, but the Grand Jury declined.
