To be fair, I don't think he was actually defending the death penalty but it still seems a rather weird position to take in my view.

Now I don't know what the acceptable error rate is in regards to the death penalty, or burglaries, rapes, etc, but there certainly is one. Whether it's discussed or not among the learned in our court system is another matter. I suppose it is. It's not an error rate I've ever seen discussed on the evening news though.
