Never underestimate the ineptitude of the US Senate.
Even if Republicans win the Senate that will not prevent a "lame-duck" Democrat Senate from approving Holder.
Even if Republicans win the Senate by only a seat or two and a Holder nomination is made after the new Republican members are sworn in, a confirmation vote is still likely. McCain stated when the two Justices (Kagen and Sotomayor) were up for confirmation that he felt the President deserved to get the appointees he wanted and Graham follows him like a pet poodle. Plus there are Snow and Collins who are really liberals.
So, don't be shocked if there is in future a Justice Holder.
