Apparenty an 18 year old girl had sex with a 14 year old girl in South Florida. Under the law this is illegal and the 18 year old could face up to 18 years in prison and be labelled a sex offender.

However, there is a huge outcry from the gay community saying that his is "unfair". I thought that these people wanted equal rights under the law. What happened?

Isnt the law different if they are only a few years apart?

Many Change.org signers say Hunt is being treated unfairly because she is a lesbian.

“Being gay and in a same-sex relationship, I find this ridiculous and appalling,” wrote Nathan Johnstone of Melbourne, Fla. “I highly doubt this would be happening in if it were a ’traditional’ relationship.”

The authorities do deny this but it seems that the claim is that gays are being (again) singled out for unfair treatment. In order to judge whether it is true or not I'd need more information regarding the treatment of heterosexuals in the same situation (i.e. high schoolers in a consensual sexual relationship).

No 18-year old of any gender or sexual orientation should face a prison sentence for having consensual sex with a 14-year old (unless perhaps in certain special circumstances, such as the 14-year old being mentally disabled). But yeah, "unfair" is a poor choice or word. "Retarded" would be better.

Florida

The age of consent in Florida is 18, but close in age exemptions exist. By law, the exception permits a person 23 years of age or younger to engage in legal sexual activity with a minor aged 16 or 17.

794.05 Unlawful sexual activity with certain minors.-- (1) A person 24 years of age or older who engages in sexual activity with a person 16 or 17 years of age commits a felony of the second degree, ...Title XLVI, Chapter 794

It's a puzzle why the prosecutor insists on a plea deal which contains a felony conviction; cases like this are routinely pled down to misdemeanors or less.

unless those two girls are the only human beings in that school, there be a lot of lovin between 18 year olds and younger students. and that is true worldwide. since i don't see any other 18 year olds being prosecuted, this seems like an obvious case of persecution.

Most places have either no penalty, or a much less penalty for 18 year olds having sex with 16 or 17 year olds.

You're right in that it should not be hard if this is special treatment or not. But you should compare apples to apples. (e.g. 18 year old boys and 14 year old girls).

If it were my 14 year old daughter, I'd call the police and expect prosecution.

I agree that sexual contact between 18 year olds and 14 year old should be illegal but absent some extraordinary circumstances I fail to see why it should be treated as severely as it is being done here. Insisting on a felony conviction with all its lifelong consequences to this girl seems unduly harsh.

Presumably then if your son or daughter were the 18-year old in this case, you would call the police and expect prosecution?

that sort of thing is a nightmare to legislate but i think the same rules must apply for gays and straights

Also, it says "up to 15 years". Which by itself means "as little as no jail time at all". No state is going to write a separate law for each age pair (e.g. an 18 year old and 14 year old gets 2 years in jail, an 18 year old and 13 year old gets 3 years in jail). They write a few clauses and let the judge have some discretion. Until we hear differently, I would not expect the judge to treat this any harsher than an 18 year old boy having sex with a 14 year old girl.

Nobody is asking for separate laws based on same or opposite gender. The question is whether in similar cases (18 with 14) the District Attorneys in their state typically insist on the pressing the harshest crime, or if they normally offer to plea it down to a lesser offense.
