It's a defamation lawsuit about the accusations Hans cheated over the board. It is not about online play.
I think he has a case. If people can sue for burning themselves while drinking coffew and winning the case then Hans definitely has a chance.

Many people are named in the lawsuit such as Nakamura and Danny from chess dot com.

Nakamura was the one who was the worst for the accusations.

He never accused Neimann of cheating he simply laid out why Magnus may have a point. Nakamura was pretty objective in his assessment, based on what I've seen.

Both Magnus and Nakamura were quite careful in choosing their words. Magnus didn't directly accuse Niemann of cheating until about a week or two ago. Even then, there were no character assassinations, just Mag's opinion.

He may have a case against chess dot com though. They banned without any concrete reason to do so. But even then, they can still point to Niemann's two previous bans where he was both caught cheating and admitted to it.

He did not accuse him of cheating, just implied it.
He suspects Hans cheated because he cheated before and admitted it. Hans' reputation was already soiled by himself.

Hans does not have a chance. All this suit does is reinforce people's opinion that Hans is a creepy guy without honor.
