Both Magnus and Nakamura were quite careful in choosing their words. Magnus didn't directly accuse Niemann of cheating until about a week or two ago. Even then, there were no character assassinations, just Mag's opinion.
He may have a case against chess dot com though. They banned without any concrete reason to do so. But even then, they can still point to Niemann's two previous bans where he was both caught cheating and admitted to it.

He suspects Hans cheated because he cheated before and admitted it. Hans' reputation was already soiled by himself.
Hans does not have a chance. All this suit does is reinforce people's opinion that Hans is a creepy guy without honor.
