If lawyers are drafting these agreements, you can bet your last dollar the "story" will never end. Billable hours. Their world revolves around billable hours! 😏

Without seeing the actual agreement, it is really impossible for anyone to make reasoned judgments about what it was meant to cover. I have not seen any articles with links to it and it has been referred to in some as "secret".

It's basic law that interpretation of a contract is based primarily on the written words used in the contract and that extraneous evidence is only admissible if the contract wording is ambiguous. The Court seemed to be suggesting that the wording isn't:

"An application by Harry Dunn's parents for the Foreign Office to disclose evidence relating to a "secret agreement" between the UK and US governments has been rejected.

The Dunns said the agreement had given diplomatic immunity to their son's alleged killer, Anne Sacoolas.

The 19-year-old was killed in a crash in Northamptonshire.

At the High Court, Lord Justice Flaux said disclosure was not necessary for the "just determination" of the case."

The individual giving evidence in the Guardian article "“Tony Baldry himself admits he had no recollection of the submission and does not recall seeing the final agreement.

So, at this point, it's difficult to sort out the competing claims absent the actual text of the agreement.

The OP copy pasted the entire article except for the concluding three paragraphs:

But the FCO insisted there was no waiver of immunity for spouses in the original Croughton agreement set out in 1995.

It added: “The FCO identified this anomaly after the tragic case of Harry Dunn. The foreign secretary instigated a full review of those historic arrangements – presided over by previous governments – and is now working to correct the anomaly.”
