"Requests for Admissions" are a discovery device. Obama's lawyers filed a motion to dismiss the suit on September 24, 2008 and followed that up with a motion (October 6, 2008) staying discovery until the dismissal motion is decided. These are routinely granted; there's little point to discovery if the complaint is legally insufficient. The Court hasn't decided either motion yet; it normally takes at least a month to get a decision in a motion after all parties have filed papers.
Ridiculously, Berg made a motion on October 21, 2008 to have the statements in the "Requests for Admissions" deemed admitted. His chance of winning this motion is zero as Federal rules require the Court to set a discovery schedule if the parties can't agree on one (which they clearly can't here). Presumably, when the Judge issues a ruling on the motion to dismiss, he'll deal with the discovery issues in the highly unlikely event he doesn't dismiss the suit.
I dealt with this nonsense in another thread; Berg is a clown. The level of Republican desperation is high to have anyone even take this at all seriously.
