The vast majority of land that borders Mexico is privately owned. The Federal Government cannot simply take that land from the owners and build a wall on it. Using Eminent Domain laws to do it will be challenged in the courts on a case by case basis. George W Bush tried something like this 15 years ago, and many of these cases are still pending today (and not successfully either!)
