I suspect it is the former. The truth is that there are a handful of states [less than 4] that ruled Trump engaged in insurrection as defined by the 14th Amendment. The other states rejected attempts to disqualify Trump. You can if you wish condemn Trump for other misdemeanors, but insurrection is not one.
