I would normally agree. What you are saying would be true if the sandwich thrower threw the sandwich at an old lady minding her own business walking down the street. But in this case the military took over this man's town for no stated reason other than grandstanding. The sandwich thrower would not have thrown the sandwich at the officer if the military wasn't in the streets. Its an objectively harmless object so charging this person with felony assault would be silly.
