As far a legality, my understanding was that it is a type of "sage" and that you couldn't easily criminalize it without outlawing all species of sage.
The argument that it's a type of sage and you couldn't outlaw it without outlawing all other types of sage doesn't make much sense to me. You could outlaw the active agent. That's how the law works in Germany when it comes to psychoactive mushrooms, where you would have the same problem as with sage.
