Unless the job is for a federal department I thought it's classed as an illegal search to drug test before employing someone?

No, drug tests are always given before hiring, been that way forever. Where did you get that silly idea?
As far as weed, despite what you've been told, ONE week off of it is plenty of time to pass, I know this from experience.
