I know nothing about how to hack computers, yet once when I was playing around on my laptop on a bussiness wireless network, I got into their network, and had access to their whole store. If they threw a lawsuit againts me, for my lawyer to say that I dont have the knowlege to hack (and I dont) is not a valid argument.
You lacked the means to carry out the crime. I am not sure where you are from but American legislation is even more definite than the UK's. We have murder (absolute) and manslaughter (to describe causing death through negligence or without malice aforethought [eg crimes of passion in some cases]. In the States I believe they have Murder 1, Murder 2 etc to accomplish the same task of discrimination.
