"It's" as opposed to "its" is not a spelling mistake. It is the incorrect use of an apostrophe and hence is a grammatical error. Further since posts are semi-permanent I reserve the right to employ the present tense.

The use of apostrophes is a spelling convention, not a matter of grammar. Using "its" instead of "it's" is correct grammar, but wrong spelling. Using "he's" or "it are" instead of "it's" would be correct spelling, but wrong grammar.
