Time limits: exist they or are they just theory?

When diuperup has moved 28.a5 (May 20, 18:10), his timebank was already expired (2 min before: 18:08). No matter if since 2 minutes or since a month: when it's expired is expired.
In such a cases the skull should appear automatically. Once, it was so. Instead, in the tournament at least, it's different. This is the third time that one of my opponents goes out of time. When Kamikazzi went out of time, I have had to wait for several hours to claim win. This did not create problems, because Kamikazzi avoided to play at time expired.
But diuperup made a move, this way keeping open the game.
I understand him and I justify him as well. However, if there's a rule which establishes that, if your opponent doesn't move within the available time, you can claim win, you must have the possibility to do it. Otherwise, the rule about the time limits becomes pure theory.
Can someone of the staff do something about this? as closing the game at 18:08?
