I think there is a simple alternative to address the concerns of players who do not use or intend to use openings databases or other reference materials: A field in the player's profile that captures whether he or she intends to play as in OTB (i.e. using only his/her memory) or not. This way, a player can filter out db users from the search feature. And of course db users can filter out play-as-in-OTB players.
However, I'm now convinced that is not fesible to create a new class of tournments and clan challenges where openings databases are not allowed. As Kepler pointed out, there is no way to enforce this.
But I recommend introducing random chess tournments and clan challenges, and the openings issue becomes a non-issue.
