(If the game is drawn) You should take action first and offer another draw, because if you don't and he thinks the same way you do, you will both end up making several moves and wasting time on a drawn game.
From a psychological point of view, if you see someone getting murdered on the side of the street with plenty of people around, you must take action and call 911, because the vast majority of people (if not all) will think someone else will call 911, and no one will end up doing it.
Originally posted by Maxime FerlatteI already offered a draw when I was a pawn up but my opponent was cynical and just played on as if nothing happened. Now that he has recaptured the pawn, he now offers me a draw. Perhaps I should make him wait to claim for the 50 move rule? 😀

Originally posted by CCNoobI am the person in question, and I was not cynical- I simply missed the draw offer. I was even checking the "accept a draw offer" box every time I was putting in conditional moves. I am sorry I got you all fired up about this, and I regret that I missed the offer when you made it. We have certainly wasted more of our time on a meaningless position than we should have.

As I have thought about this some more, I think that if I would offer a draw AFTER winning a pawn, then it stands to reason that I would have been partial to a draw before I won the pawn, when I was a pawn down.
I would have offered a draw sooner, but I felt it was bad form to offer one when I was a pawn down, and I was waiting for an offer. When you allowed me to win the pawn, I took that as an implicit draw offer, so I made the offer just to formalize it.
Oh well!

We've each apparently offered a draw, and I offered the last one, but I'm not going to quibble either way. Each player has g and h pawns, and the bishops are opposite color, and I think each of us has made incorrect assumptions about the intentions of the other player. I have offered a draw at any time going forward, so we'll see when we finally close the case.
