The 5 questions from the article:

1) Can prosecutors prove Trump knew his claims were false?

2) Why was Trump not charged with aiding or inciting an insurrection?

I stopped with #1, BECAUSE the claims of Trump are irrelevant. What he thinks about the election etc is not a crime. You kids sure throw that word crime around a lot.

You are correct. What he thinks is not a crime. He is not being charged for speech. He is being charged for conspiring to obstruct the peaceful transfer of presidential election results.

Uhhh, give me an example of a 'claim' that one might make which would amount to a crime. Like, if I go out to the park and claim xyz, it would be a crime.

So, you state here that what he said is not a crime, but then you are saying he was obstructing the transfer,,,,,,,,,but that was speech, phranny.
So, is his speech a crime, or is it not a crime?

When you conspire to defraud the US government, you use words. Is that speech or conspiracy?

"The purpose of the conspiracy was to overturn the results of the election by using knowingly false claims of election fraud to obstruct the federal government function by which those results are collected, counted, and certified."

So, of course they used words/speech. The crime is not the speech. The crime is the obstruction.

An analogy:

"See that bank across the street? All the money in there is actually mine, but the bank stole it from me. I need your help in getting my money from the bank; you need to do X,Y and Z."

So the crime starts with a claim and then proceeds by overt acts to attempt to obtain an illegal purpose.

That's a criminal conspiracy.

No no no, I asked Phranny why he said what he did, which were conflicting statements. He hasn't answered, and you say nothing. A long night.

Not on subject sorry. Making a claim is what I said, not screaming an upset to a crowd. Making a claim. Making a claim, Sue. Trump did not scream like a person in a crowded theater. Forget it,, you won't think of one.
