Trump's policies are largely illegal (like declaring the suspension of asylum and his use of the Alien Enemies Act) and will eventually be reversed. Biden, to his credit, did not act illegally just because there was an increase in crossings largely due to economic factors caused by the success of his policies compared to the rest of the world in the immediate aftermath of COVID.
