They let them live because they had not physically breached the cordon with their physical bodies, they are obviously not murdering scumbags and they follow rules of engagement.

Because he didn't enter the area where members of Congress and their staff were being protected by armed guards and she did.

Alam is awaiting trial; he is charged with "assaulting a federal officer; obstructing law enforcement engaged in official duties incident to civil disorder; knowingly entering or remaining in any restricted building or grounds without lawful authority; violent entry and disorderly conduct on Capitol grounds."

Actually it's not "hearsay" which is "Hearsay is an out-of-court statement offered to prove the truth of whatever it asserts." https://www.law.cornell.edu/wex/hearsay

Babbitt's statement wouldn't be admitted for the truthfulness of her assertion that "they're not gonna stop" but for her state of mind which was in support of the officers letting the mob into the area where members of Congress and their staff were being protected by armed guards. She obviously showed that support by being the first one to enter the area (and the last one due to the officer's action).

No video shows Babbitt clearly saying anything in front of the Speaker's Lobby AFAIK. There is a video where she claims 3 million people are there to support Trump.
