Let me try to clear this up since Mott's doing such a poor job of it.
The defense wanted to call an "expert" on election finance law. In their proffer of what his testimony was to be, they said he would testify that Cohen paying the hush money to benefit Trump's campaign wasn't actually a violation of the law (mind you, Cohen pleaded guilty to that crime in a case brou ...[text shortened]... aw gives judges wide latitude in deciding what expert testimony can be included.

Anyway, NY State prosecutors can enforce the laws of this State regardless of discretionary decisions by Federal agencies. The jury found Trump guilty of all charges which explicitly requires an intent to commit "another crime".
The wording of the statute is pretty clear:
Penal Law Section 175.10
Falsifying business records in the first degree
A person is guilty of falsifying business records in the first degree when he commits the crime of falsifying business records in the second degree, and when his intent to defraud includes an intent to commit another crime or to aid or conceal the commission thereof. Falsifying business records in the first degree is a class E felony. (Emphasis added)

The wording does not limit "another crime" to ones that are violations of NY Penal Law. An appellate court would have to find some hidden meaning which contradicts what seems to be unambiguous language.
