Today is the 10AM SCOTUS hearing on Birthright Citizenship. Televised.
Consider my perplexing question as the hearing opens up, I wish that I could ask that question with my opening argument.
You guys have batted this around for some time. I mean, if my baby is born while I am on a fishing trip in Mexico, the baby is NOT going to be considered a Mexican citizen.............Hello??????
So, yet you and marauder et al argue that a Mexican lady who comes here for whatever reason, who is a mex citizen, could have a baby, and that We Should Consider That The Baby Is A Citizen Of The United States Of America!?!?!?!?
Would SOMEONE comment on this? RHP pays me big bucks for brain teasers, but I will not charge them for this one, as it is a slam dunk.
@AverageJoe1 saidThe Constitution says it.

Get over it.
BTW, Mexico has birthright citizenship also.

I'll put it this way… What is the difference of the following scenarios:
My being in Mexico and having a child while in Mexico that will of course be a US citizen after it has been born, and we come back to the USA.
A French Citizen being in the USA and births a child here. Is the child a frenchman or is it an American?
A Mexican citizen being in the USA, birthing a baby, ,,,,,,,,is the baby a Mexican citizen, or is it a USA citizen? Would the french parent's baby be a french citizen if i were born in Kansas, or go back with the parent to France as an Amerixan Citizen?
This is all for fun discussion. There is no question in my mind that the court will throw this to Congress. We are just having fun with this scenario situation. I am waiting for you to come back and say to me that my baby born in Mexico would be a Mexican citizen. Because you are saying that a Mexican baby born in the USA is a USA citizen. Just what are you saying anyway
For the record, as you say, Mexico has birthright citizenship. It enforces my point. So if my baby is born there it becomes a mex citizen!?!?!?!?!? Now you see how horrible all this has become.
@AverageJoe1 saidCongress enacted an immigration law in 1940 which, among other things, contains the same language as the 14th Amendment clause authorizing birthright citizenship.

Anyway, tell us the status of the babies of Americans that may be born in France. Would they be French citizens or American citizens. We can start with that and then work it into a discussion.
French, or American?
@AverageJoe1 saidI'm not an expert in French law.
Yes. You are right.

Sorry.
my brother married a filipina lady when he was in the air force, clark air base, manila
he got transferred to germany, ramstein air base
she had three children, born in a german hospital, not on base
two nephews, one niece
he, and they, transferred to colorado springs where he was discharged
his wife became a naturalized citizen by doing all the necessary paperwork,
chanting of spells cast and the dancing away of evil spirits,
while swearing allegiance to the constitution of the united states of america
wave that flag!
hold on
are my nephews and niece citizens?
are my niece's three children (born in colorado springs) citizens?
is my texas born brother a damn citizen?
oh my, i sure hope tom homan stays clueless
@AverageJoe1 saidIn which case, he/she would have dual citizenship, you moron.

Actually, France has quasi-birthright citizenship.
If the baby remains in France for 5 years, it gets citizenship. He/she can also gain automatic citizenship at 18, if they are currently living in France, and at age 13 by declaration. All this applies only if the child were born in France.
With both parents US citizens, it would have US citizenship at birth. Actually, only one parent needs to be a US citizen for the child to be a US citizen.
Interesting how you suddenly changed your hypothetical from Mexico to France. You probably looked all this up in advance.
@rookie54 saidAll US citizens, since only one parent needs to be a citizen. His naturalized wife is also a citizen.

Indeed, and how can we dictate just ‘what’ they are? They might not want to be. The baby in France…”YOU are a Frenchman!” if I am on a fishing trip in Mexico, and my baby is born there, she might not want to be considered a Mexican. Of course I speak generally some countries do not allow dual citizenship, but we are just batting the issue around to show how everything is getting out of hand in this world. No one can even be who they want to be. The socialist want you to be what they want you to be. It goes on from there.
@Suzianne saidGermany, Netherlands, Austria and Norway, our countries that make it very impossible, and certainly do not automatically recognize dual citizenship. Yes France, which was my example provides for it, but let’s say my daughter is born in a country that does not allow dual citizenship. What a mess.
In which case, he/she would have dual citizenship, you moron.
