@phranny saidA clear-eyed repudiation of the current ideological destruction of America represented by the current Court.

Heather Cox Richardson
Today at noon, Ketanji Brown Jackson was sworn in as the first Black female justice on the Supreme Court.
Before Justice Brown took her oath, the court also signaled the end of the federal government as we know it.
In the past, the Supreme Court has operated on the basis of “stare decisis,” which literally means “to stand by things d ...[text shortened]... .supremecourt.gov/opinions/21pdf/20-1530_n758.pdf

@no1marauder saidAbsolutely agree. An obvious assessment.
The "major questions doctrine" is something totally concocted in the last few decades by right wing justices. It has no Constitutional basis.
Moreover, even if such a doctrine was justified, it was totally inappropriate in this case where the statute clearly and plainly gave the EPA authority to regulate by virtually any means necessary (subject to explicitly mentioned ...[text shortened]... was).
The decision is demented nonsense in ideological service to Big Business by partisan hacks.
@averagejoe1 saidShe is absolutely correct, as usual.
Lotta stuff here. It is on google'.
I was simply asking for opinions, regardless of all you just typed, of the comments of Kagan, which are obviously nothing to do with her job. It is bad enough that she said it, but in her Dissent!?!?!? I do not want her to be justice anymore, where to I vote!! She got personal, just like the whiney libs here do.
@averagejoe1 saidNo, she didn't, unlike the majority in this decision.
Even the erudite Marauder avoids the fact that this justice stepped out of her role, while on company time!!!, to make this. comment. Really bad of her, Marauder, really bad. Your thoughts?
@mott-the-hoople saidFull of crap, as usual.
the EPA was never granted complete control to shut companies down. Richard Nixon created the EPA, not the representatives.
The EPA as with other agencies were weaponized by democrats to further their agenda. Again, The EPA was NEVER given absolute power. You as usual misrepresent the facts. The EPA was to work with the states and make recommendations, not given a dictatorship.
Dems abuse every thing they touch.

@averagejoe1 saidYou, like Mott, are full of crap.
May I add that your 'denier' reference points out the fact that some people believe there is no global warming, certainly that humans have little to do with it. I don't know myself, that is not my point.
My point: Since it is not a proven fact, then this Kagan character is telling us ONLY her personal opinion on global warming. She could be wrong, could she not? ...[text shortened]... ngerer. She has my family and myself scared to death. This is totally unbecoming of this judge.
Obviously.
@mott-the-hoople saidDo you even understand the meaning of 'beyond'?
well I’ll be…The EPA web site is lying then…
“Following the council’s recommendations, the president sent to Congress a plan to consolidate many environmental responsibilities of the federal government under one agency, a new Environmental Protection Agency. This reorganization would permit response to environmental problems in a manner beyond the previous capability of government pollution control programs:”

@averagejoe1 saidThe 'mobsters' in this case, are the Supreme Court of the United States.
Note that, today anyway, Kev and Marauder will NOT comment one way or another on a 51% majority rule. They are embarrassed about such a position, or they are confused, I just cannot tell. They are mob-sters, but are ashamed to admit it.
@mott-the-hoople saidEven more symptoms of being full of crap.
congress only APPROVED Nixons plan idiot, but you know that, its just that in your mind you are never wrong…AJ is a man of character in admitting wrong, maybe you could adk him for tips
@mghrn55 saidThe 'rough ride' Clarence Thomas was given over the 'Anita Hill affair' was far, FAR less than he should have gotten. It should have kept him off the Court, a job he obviously did not deserve.
I read somewhere a few days back that Clarence Thomas was saying that he would make life miserable for liberals as long as he was on SCOTUS.
This was in retribution for the rough ride he was given over the Anita Hill affair.
This seems a lot more harmful in terms of stepping over one's boundaries of the job.
Seems a little angry for the job, one would think ?
@mott-the-hoople saidThe states have clearly shown they are not up to that job.
what marider1 says;
"The language of the Act clearly grants to the EPA power to identify and regulate air pollutants. "
what the act says;
"The EPA would be able--in concert with the states--to set and enforce standards for air and water quality and for individual pollutants.'
in concert with the states
Its called lying by omission
@mott-the-hoople saidSince when is the destruction of America "fair play"? What planet are you from?
turn about is fair play right?
@suzianne saidNo one knows if she is correct, Suzianne. The world has been changing up and down for billions of years. There scientists who say there is no global warming. Yeah, we know, they are stupid.
She is absolutely correct, as usual.
So, you cannot say that she is correct. And even if she were, she should not put her personal feelings in a dissent.
