(A) Except as provided in [paragraph] (B) of this section, food employees shall wear hair restraints such as hats, hair coverings or nets, beard restraints, and clothing that covers body hair, that are designed to effectively keep hair from contacting exposed food; clean equipment, utensils, and linens; and unwrapped single-service and single-use articles."
It even has a rule regarding the use of gloves: "Section 3-304.15 of the Food Code includes guidelines on how frequently employees should change disposable gloves, called single-use gloves in the Food Code, throughout the stages of preparing meals.
(A) If used, single-use gloves shall be used for only one task such as working with ready-to-eat food or with raw animal food, used for no other purpose, and discarded when damaged or soiled, or when interruptions occur in the operation."

Surely if the Feds can pass health and safety measures aimed to prevent stray hairs or ungloved hands getting on food because of the health risks, it can pass rules aimed at preventing the spread of deadly diseases among employees and customers.

carry the same penalties,
and are ENFORCED AS LAW.
While they might not be laws, a mandate is still legally enforceable. In fact, they will often have the same effect as bills that have passed into law. Additionally, mandates can be as widesprad. Returning to the example, the mask mandate puts restrictions on individuals. Some rules will affect business owners.

The Constitution specifically allows the Feds to regulate interstate commerce. All restaurants are involved in such commerce, as are airlines, Uber and Lyft, companies with over 100 employees, etc. etc. Therefore, the Constitution is not an impediment to "mandates" i.e. requiring businesses and individuals to do certain things.
