This is the crux of the Court's entire argument; that unless unenumerated rights were recognized by State legislatures in 1868, they don't exist. But nothing could be further from the Natural Law principles that the Framers believed in than that.

For example as of now, the Real Clear Politics aggregate of polls has Republicans with a 3.4% advantage in the generic Congressional vote. Might also want to check out polls regarding the most important Senate races as well.
