If Batman knows that Joker frequently escapes prison to go on yet another murder spree, is Batman responsible if he doesn't eventually kill the Joker? Or should he just keep being a hero constantly returning Joker to prison?

The Joker has become too dammed good at killing the citizens of Gotham, he has to go.

@vivify saidI'm not sure if it is appropriate for Batman to unilaterally make such a decision. But there is a legitimate purpose for the death penalty and certainly if imprisonment isn't an option to prevent the future murder of multiple innocent people, I would argue that it definitely should be applied here.
