@athousandyoung saidInteresting opinion.
They were idiots. If you need to protect your property during a riot you hide with your weapon (on the roof is a good place) and fire warning shots if someone tries to light a fire or kick in the door. Two guns is not going to stop a mob that wants to kill you if you are standing in plain sight brandishing them.
But you know, not everyone can be as smart or as wise as you in these affairs.
You should take pity on their ignorance of the situation and try to humble yourself to thinking about this from the perspective of your lessers.

@philokalia saidActually they probably knew what I'm saying but because this was NOT a riot they felt safe in posing with their weapons. It made their balls feel big.

@philokalia saidAnd I'd simply say that your interpretation of the law and facts would have allowed them to open fire on those marchers, kill them and then successfully plead self-defense. IF Missouri's Castle Doctrine can be successfully invoked under these circumstances as a defense to 571.030(4), it could be successfully invoked as a defense to Murder.
I'd simply say that they did not kill anyone.
They certainly exercised bad muzzle control out there, but I understand why they were shocked and worried -- especially if you fully believe their account of their interactions with the protesters.
@philokalia saidYou haven't watched any of the videos, have you?
Then it comes down to how much we believe that they were angry and threatening in their display of the weapon.
And that would also factor in whether or not we believe their poor muzzle control is purposeful in this regard -- as Soothfast has pointed out in other places, at various points the woman was even posing a threat to herself and her husband.
In one, Mark McCloskey is screaming at the marchers as they enter through the gate "Private property!" over and over again, while pointing an assault rifle at them. In others, Patricia McCloskey is shouting at the protesters and walking towards them, pointing her handgun directly at them.
I don't think the element of "Exhibits ................... in an angry or threatening manner" is much of a problem for the prosecutors given the publicly available video evidence.
@no1marauder
How many of the peaceful criminals were charged with trespassing?
pssst - they're on VIDEO
@earl-of-trumps saidI suspect that if everyone was considered a "criminal" who ever violated any law with penal sanctions, esp. minor ones like "trespassing", the great majority of American adults would fall into that category.

I'm not sure that these protesters could have been convicted of trespassing given their First Amendment rights. They were headed to the mayor's house for reasons central to their "peaceful assembly" "to petition the Government for a redress of grievances." The wording of the First Amendment (as applied to the States by the 14th) would seem to bar laws restricting such a right such as making streets where government officials live "private property".
So, AFAIK, the only persons charged in any matter relating to that days' protest were the people pointing guns.
@no1marauder
You call it MINOR when it scares the crap out of people enough for them to grab their guns?
Please. Your prejudice is as thick as mud
@earl-of-trumps saidIf they were scared they would have stayed inside their home.

on the trespassers. Don't tell panicked people, in retrospect, how to act in an
emergency from the cool and clam of your armchair. how brave.
"They shoulda', they shoulda',..."
Meanwhile you don't have a "they shoulda'" or a "they should NOT have..." for the trespassers.
Uh huh. Prejudice as thick as the fog in the bog

@earl-of-trumps saidPeople utterly afraid and confused do not actively approach those they are afraid of.
For any misjudgment these people made in their utter fear and confusion,
Doesn't happen.
Anyone who thinks it does is confusing Hollywood with reality and reads too much NRA propaganda.
@kquinn909 saidNice try. Almost a sentence.

Make sure you put a band aid on those knuckles.
With the "Defund the Police" movement raging across America, people have been
purchasing weapons like the ones that the McCloskeys had for self protection.
Gun Sales In June Shatter Records, Sales Up 145%, More Than 2.3 Million Guns Sold -Total of 8.3 Million in 2020
Numbers for the month of June indicated that Americans purchased more than 2.3 million guns in 31 days. Small Arms Analytics and Forecasting (SAAF) reported that a total of 2,387,524 guns were purchased.
June of 2020 surpassed June of 2019 by 145%. But as gun owners across the country know, it’s not just June. It’s the whole darn 2020.
June is just the fourth month in a row that gun sales were markedly higher. March, April and May reported increases of 86.3%, 71.3% and 80.2% over last year.

Bring it on, "peaceful protesters".
